These Terms of Use govern your use of the websites, content and community services offered through www.taxmiller.com ("Site"). You (the user) agree to access "the site", subject to the terms and conditions of use as set out here. Tax Miller may add to or change or update these Terms of Use, from time to time entirely at its own discretion. You are responsible for checking these Terms of Use periodically to remain in compliance with these terms. Your use of a Site after any amendment to the Terms of Use shall constitute your acceptance of these terms and you also agree to be bound by any such changes/revisions. You must be 18 years or older to use the Tax Miller services. By registering for the Tax Miller service, you represent and warrant that you are 18 or older and that you have the capacity to understand, agree to and comply with these Terms of Service.

Since Indian laws do not permit to us to contract with a minor person (minor is a person who has not completed 18 years of age), we do not market our Web site to minor person under the age of 18. However, since the Income Tax provides a minor to file income tax return in certain circumstances, in such instance we presume that the parent/guardian has registered himself to enroll the minor only as a tax payer on our web site & all the inputs, information provided our under guidance & assistance of at least one of his parent/guardian.

 

Acceptance of Terms.

Tax Miller will only collect, store, use, and share your personal information (including email address) as it is defined by our privacy statement and as regulated by Indian laws. When filing a tax return online, in addition to entering your own personal information, you may be asked to enter personal information of those who are either dependents or people for whose income your are liable. Information collected on the Tax Miller website is stored & used to prepare and electronically file users' tax returns, as well as notify you when new/enhanced products and services become available. We do not disclose user's information (including email address) to third parties except when the user requests to e-file their return. In just case, we will disclose information to the appropriate government officials if the law so compels us. We only communicate with users when necessary, such as issues with the user's tax return or to provide requested services.

Only information you have given us (including email address) is stored by us. We do not supplement your information with information from other companies. The exception to this would be when your employer has bought the services/products for bulk use for its employees and to facilitate that we may upload information provided by your employer.

When you use calculators and other tools on our Web sites that may or may not require registration, Tax Miller may collect non-identifiable data from such tools, to help us customize offers and tools to your particular interests. Tax Miller will not record or track any data you enter into standalone tools and calculators in any way that identifies you personally, unless we specifically inform you that we are doing so at the time you provide such data.

In case of change in tax laws & procedures we would try our best to incorporate the same on the site at the earliest however we do not take responsibility to always update our web site or the service/s offered instantly, at times it may take time or we may not consider to update the same for a reason, the decision of our team would be final. While offering the service/s and or product our team of tax experts have to interpret the vast number of tax law provisions & while doing so there could be more than one view possible about the same tax provision, our experts always would be interpreting the law in the most reasonable & law abiding view. Therefore the income & tax calculations may be different from another tax professional's point of view, in such an event or any other such possibilities we will not be responsible for such or other errors, misrepresentation or miscalculations in case of income or tax areas reported or displayed or printed in any form through the service/s or products. In the event of leakage of any information from the site for any reason beyond our control & for whatsoever reason Tax Miller shall not be responsible under any circumstances and no action shall lie against Tax Miller. A maximum relief granted in such an event would be subject to the payment you have made for that service or product, which we may refund to you & that Tax Miller, would be deemed to have discharged its limited liability towards you.

Subscription and / or Membership

This Site reserves the right to charge subscription and / or membership fees in respect of any part, aspect of this Site & Service/s and/or product/s upon reasonable prior notice. Such notice will be appearing on the site by displaying the new / revised charges for the service/s and/or product/s as offered time to time with or without modifications & on such display it will be presumed to be read by all users whether registered or not & no further notice would be required. The same will apply for any service/s or products being offered without any charges whenever made chargeable.

 

Member Account, Password and Security.

The Tax Miller service is made available for your personal, non-commercial use only.

You may not use the Tax Miller service for any illegal or unauthorized purpose, including misusing permanent account number (PAN) of another person. International users agree to comply with all Indian laws & regulations, including laws regulating the export of data from the India or your country of residence. You are solely responsible for your conduct and any data, text, information, graphics, that you submit, & post on to Tax Miller service.

Other examples of illegal or unauthorized uses include, but are not limited to: Modifying, adapting, translating, or reverse engineering any portion of the Tax Miller service.

Removing any copyright, trademark or other proprietary rights notices contained in or on the Tax Miller service.

Using any robot, spider, site search/retrieval application, or other device to retrieve or index any portion or the Tax Miller service.

 

Creating user accounts by automated means or under false or fraudulent pretenses. Creating or transmitting unwanted electronic communications such as "spam," or chain letters to or otherwise interfering with other user's enjoyment of the service by blocking. Submitting data of any third party without such third party's prior written consent. Submitting Materials that falsely express or imply that such Materials are sponsored or endorsed by Tax Miller.

Submitting Materials that infringe misappropriate or violate the intellectual property, publicity, privacy or other proprietary rights of any party.

Transmitting any viruses, worms, defects, Trojan horses or other items of a destructive nature.

Submitting false or misleading information.

While Tax Miller prohibits such conduct on its site, you understand and agree that you nonetheless may be exposed to such misuse or blocking by other users and that you use the Tax Miller service at your own risk.

For certain services such as email, contents and calculators, registration by the visitor is required. By registering, you agree to the following terms in addition to any other specific terms, which shall be posted at an appropriate location of the Site. Each registration is for a single individual user with creation of multiple taxpayers known to the registering user only. To access these services, you will be asked to enter your individual User Name, Password, Date of Birth, Secret Question, and Email Address & Mobile Contact. Therefore, we do not permit any of the following:-

Any other person sharing your User Name and Password unless your express permission is granted.

Any part of the Site being cached in proxy servers and accessed by person/s who have not registered with Tax Miller as users of the Site & Services

If we reasonably believe that a User Name and Password are being used / misused in any manner as clarified above we reserve the right to cancel access rights immediately without notice, and block access to all users from that IP address.

Unless otherwise stated, copyright and all intellectual property rights in all material presented on the site (including but not limited to text, audio, video or graphical images), trademarks and logos appearing on this site are the property of Tax Miller, its parent, affiliates and associates and are protected under applicable Indian laws. Any infringement shall be vigorously defended and pursued to the fullest extent permitted by law.

 

Limited Permission to Copy

You are permitted to print or download extracts from these pages for your personal non-commercial use only. Any copies of these pages saved to disk or to any other storage medium may only be used for subsequent viewing purposes or to print extracts for personal use. Our use of your personal information is governed by our Privacy Statement and we will never rent, sell or share your personal information with any third party for marketing purposes without your express permission.

It is our policy to respond to notices of alleged infringement that comply with the Copyright Act.

By submitting or furnishing any content and or suggestions other than your personal information on or through the Tax Miller service/s, you automatically grant to us a worldwide, non-exclusive, permission & irrevocable right & such content & suggestions becomes the property of Tax Miller and you agree to grant/assign the royalty free, perpetual right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed.

Indian Law

The Agreement shall be governed by the Laws of India. The Courts of law at Delhi shall have exclusive jurisdiction over any disputes arising under this agreement. General.
